QMD Studio End User Licence Agreement

1. Parties and scope

This agreement is between you (an individual or the organisation you work for) and Tuper ("Vendor"). It covers the QMD Studio plugin for JetBrains IDEs ("Plugin"). It is in addition to the JetBrains Marketplace terms, which govern purchase, payment, taxes, subscriptions and refunds: JetBrains is the seller of Pro licences.

2. Free core and Pro

The Plugin's free features may be used without a licence, for any lawful purpose, personal or commercial. Pro features need a paid licence or a trial from JetBrains Marketplace. Personal licences are for an individual using the Plugin for non-commercial work; commercial licences are for use inside a company or for paid work.

3. Licence grant

The Vendor grants you a non-exclusive, non-transferable licence to install and use the Plugin on the devices you use, for the licence period you hold (or a perpetual fallback if JetBrains Marketplace shows one for your purchase). Licence checks are done by the IDE through JetBrains' licensing service; the Plugin does not contact Vendor servers for them.

4. Restrictions

You may not redistribute, resell or sublicense the Plugin, remove licence checks, or share one licence beyond the users it covers. You may not use the Plugin unlawfully. Nothing here limits your rights under mandatory law or the licences of third-party material.

5. Third-party material

Quarto option names and descriptions are taken from quarto-cli schema files (MIT Licence, Copyright (c) 2020-2024 Posit Software, PBC). QMD Studio is independent and not affiliated with Posit or the Quarto project. Quarto is a trademark of Posit Software, PBC. The Plugin runs your own quarto command only when you start Render or Preview.

6. Your content

The Plugin processes your documents locally. The Vendor claims no rights in them.

7. Updates and support

Updates are released through JetBrains Marketplace. Support is by email at support@tuper.app on a reasonable-effort basis.

8. Warranty and liability

The Plugin is provided "as is", without warranty of any kind, to the extent allowed by law. The Vendor is not liable for indirect or consequential loss or lost data; total liability is limited to the amount you paid for the Plugin in the 12 months before the claim. Nothing excludes liability that cannot be excluded by law.

9. Termination

The licence ends when the licence period ends or if you breach this agreement. Then stop using Pro features and uninstall if you wish.

10. Changes and law

The Vendor may update this EULA for future versions; the version shown at installation applies to that release. Disputes: the courts competent under the law of your place of residence if you are a consumer; otherwise the laws of Israel.
